MEDIATION
Mediation is a
process where a 3rd person is involved to resolve
a dispute between two other persons. Gregory Turley is
experienced in representing his client in mediation, having
participated as an attorney in over 50 mediations, the
largest of which included 20 different parties.
Mediations
usually take a half-day to a full day, but it is not
uncommon to go two or more days.
Mediation is
nearly always required in Civil Litigation cases before the
court will conduct a trial. Often times, more than 1
mediation will be held, therefore, being an effective
advocate in mediation is very important in a Civil
Litigation context.
The idea of
mediation is to:
-
Restore communication between the parties
-
Allow the parties to come to a decision on their own
-
Explore creative options for resolution
-
Consider the weaker points that each side has
-
Memorize the agreement in a manner than can be completed
The cost of
mediation is usually shared equally by both sides and is
usually very small cost compared to a trial.
Other
advantages that the parties can find in mediation are to
create a Win/Win situation, through an early resolution of a
dispute, to preserve a business relationship, and avoid
putting the decision in someone else’s hands
Gregory E. Turley is also a trained mediator since 2005.
He has a certificate from the 40 hour mediation training
course and he has personally conducted over 10 mediations.
His mediation style is to spend as much time as possible
to open session to get the facts agreed upon, so that there
may be more time for resolution of the unagreed issues.
